These Terms of Use regulate the use of the KauppakamariVerkko service published by Helsingin Kamari Oy, a company owned by the Helsinki Region Chamber of Commerce.

The address of the KauppakamariVerkko service is http://www.kauppakamariverkko.fi.

Users undertakes to comply with these terms when using the KauppakamariVerkko service. A subscriber to VerkkoMainos, registered user and customer ordering a banner location are deemed to have accepted these terms and undertaken to comply with the same when registering with the KauppakamariVerkko service.

Registration and subscription

1. Non-registered users (free of charge)

Non-registered users are able to view company presentations, references and advertisements to the extent allowed by the advertiser. Additionally, they may activate an alert service for specified searches to send a message to the e-mail address indicated by the customer.

2. Registered users (free of charge)

Registered users will be able to view company presentations and edit the basic data on their own companies. Registered users also see the references given to other companies and may issue references to others. Additionally, the users can view the advertisements and activate an alert service for specified searches to send a message to the e-mail address indicated by the customer.

3. Registered users with subscription to VerkkoMainos

VerkkoMainos is a service provided for Chamber of Commerce members for a fee. VerkkoMainos is company-specific with all the registered company users having equal access to the service. Users with subscription to VerkkoMainos are able to view all the company presentations and edit the data on their own companies and post advertisements and similar material to the KauppakamariVerkko service. Users with subscription to VerkkoMainos are able to view the references given to other companies and issue references to others. Additionally, the users can post and view the advertisements and activate an alert service for specified searches to send a message to the e-mail address indicated by the customer.

4. Banner customers

Bannerimainos is a service provided for all Chamber of Commerce members for a fee. The subscription is for a fixed period of time as specified in the order confirmation. The advertiser is liable for the factual content of the advertisement and all the intellectual property rights and other permits and consents required for the use of the advertising material. Helsingin Kamari Oy is entitled to delete any disputed or otherwise offensive material from the service.

User ID and password

The right to use the KauppakamariVerkko service is specific to each individual company. Helsingin Kamari Oy approves and releases to the users registered with the KauppakamariVerkko service a user ID and password allowing the users to edit their own information. Where possible, Helsingin Kamari Oy checks the user’s data in its own registers in order to prevent potential misuse. Helsingin Kamari Oy disclaims all liability for any inaccurate advertisements posted by registered users. Disclosure of the user ID and password to any third parties is strictly forbidden.

Users are responsible for the acquisition and maintenance of all the hardware, software and data communications facilities required for the use of the service including other technical equipment and related cost.

Right of use and term of the agreement

Helsingin Kamari Oy grants the users of the KauppakamariVerkko service the right to use this online service in accordance with these Terms of Use. The right of use commences when Helsinki Kamari Oy releases the user ID and password to the registered user or when the banner order is confirmed. The right of use is valid for a period of 12 months from the date of order (see Fees).

Registered users are required to take due care of the user ID and password. If it transpires or there is reason to believe that the user credentials have got into the hands of any third party, the user must change the credentials immediately using the service. Helsingin Kamari Oy is also entitled to revoke the user rights associated with such credentials and take any other action it deems necessary to avert loss or damage.

Registered users may use the KauppakamariVerkko service on their personal computers and print out related material for their own personal use. The right of use does not authorise the users to copy the database or computer software forming part of the KauppakamariVerkko service.

Copyright

The KauppakamariVerkko service in its entirety, the database related to the service and all the information and computer software contained in it are copyright-protected under section 1 of the Copyright Act with Helsingin Kamari Oy holding copyright to all said works.

The database related to the KauppakamariVerkko service and the materials or data contained in it may not be reproduced, released, published, exploited commercially or otherwise used other than in compliance with these Terms of Use except subject to express written permission from Helsingin Kamari Oy.

Title

Title to the KauppakamariVerkko service and the database and data contained in it is retained by Helsingin Kamari Oy. The website is set up by NXC Finland Oy.

Fees

Helsingin Kamari Oy charges fees for the use of the KauppakamariVerkko service in accordance with its then-current price list. The price list is available at www.kauppakamarikauppa.fi or www.kauppakamariverkko.fi.

Subscription to VerkkoMainos included in the KauppakamariVerkko service is a continuous subscription valid for a period of 12 months from the date of receipt of the user credentials unless terminated prematurely.

The subscriber may terminate the subscription by giving written notice to this effect by post or e-mail to the Customer Service at kauppakamariverkko@helsinki.chamber.fi. Termination is effective as of the beginning of the following invoicing period. The notice of termination must be given at least one month in advance of the beginning of the following invoicing period.

A special invoice is sent for any additional services provided (unless paid for online), the payment time being 14 days net. All prices are quoted without obligation and value added tax at the applicable rate is added to the prices.

The customer has the right to modify the order or file a complaint within 7 days of the date of dispatch of the order confirmation.

Assignment

The data contained in the KauppakamariVerkko service may not be disclosed to third parties other than for the purposes defined in the section "Right of use and term of the agreement". The right of use to the KauppakamariVerkko service may not be leased or loaned. Registered users have the right to assign their rights under these Terms of Use subject to the following conditions:

the assignees accept these terms of use, and
the assignee and their contact details are promptly reported to Helsingin Kamari Oy.

The assignee must file a notification with the Customer Service of Helsingin Kamari Oy concerning the assignment of the credentials and order their own user ID and password. Upon assignment all the materials related to the KauppakamariVerkko service must be relinquished and all the data downloaded from the KauppakamariVerkko service to the assignor’s hard drive must be destroyed. Assignment is deemed to have been completed when Helsingin Kamari Oy releases the user ID and password to the assignee.

Helsingin Kamari Oy’s liability

Helsingin Kamari Oy will use is best efforts to ensure the continuous availability of the KauppakamariVerkko service and the accuracy of the data. Because the content of the service consists mostly of advertisements posed by third parties and the service is provided over a data transmission network, Helsingin Kamari Oy disclaims liability in the following situations:

Helsingin Kamari Oy is not liable for any unavailability of the service due to technical failure, servicing or other such circumstances nor for any unavailability of data communications connections or the internet network.
Helsingin Kamari Oy is not liable for any direct or indirect loss or damage incurred by users or third parties as a result of any error or flaw in the service or the use of the data contained in the service.
The service also contains links to websites other than those maintained by the Helsinki Region Chamber of Commerce. Helsingin Kamari Oy does not control such sites and disclaims all liability for their content or lawfulness.

Other terms and conditions

Helsingin Kamari Oy is entitled to amend these terms by notifying the customer or the customer-designated user thereof. If the user does not accept the amended terms, they must terminate the agreement within two weeks of receipt of the notice of amendment.

Helsingin Kamari Oy is entitled to terminate the agreement subject to thirty (30) days' notice. The notice of termination can be given through the service, by e-mail, by phone or by post. Helsingin Kamari Oy is entitled to terminate the agreement with immediate effect if the user defaults on the payment of the fees charged for the service or if the user uses the service in violation of these terms, laws, official regulations or accepted practice.

Any disputes arising out of this agreement will primarily be settled through negotiations between the parties. Failing that, the dispute will be referred to the Helsinki District Court in accordance with Finnish law. Consumers are also entitled to bring action at the district court in their domicile.

If the subscriber resigns from the Chamber of Commerce, the subscription to the KauppakamariVerkko will lapse at the same time. The subscriber is not entitled to any refund for any outstanding invoicing period.
